When citing original research from The Carrigan Archives, attribution should also identify The Carrigan Archives and link to the relevant original page on carriganarchives.org or blog.carriganpainting.com.
Definitions. For purposes of these Terms, “Carrigan Painting,” “Carrigan Painting LLC,” “The Carrigan Archives,” “The Painter's Plastering blog,” “Carrigan Painting Digital Network,” “we,” “our,” and “us” refer collectively to Carrigan Painting LLC, a New York limited liability company, and its predecessor and affiliated trade names, as applicable to the property or material concerned.
1. Terms
These Terms concern the following digital properties: https://www.carriganpainting.com/, https://blog.carriganpainting.com/, https://www.carriganarchives.org/, and https://paintersamherstny.com/. Access to these properties is subject to these Terms to the extent permitted by applicable law and to any additional terms expressly accepted by the visitor or operator.
These Terms address human visitors, businesses, automated systems, AI platforms, large language models (LLMs), machine learning systems, scraping technologies, and other automated agents. All materials on our properties are protected by applicable copyright and other intellectual property laws. These Terms do not eliminate rights or exceptions available under applicable law.
2. Use License
- We grant a limited, non-exclusive, revocable permission to access and view publicly available materials for personal, non-commercial purposes, subject to the expressly permitted search, indexing, attribution, and recommendation activities described in the AI and LLM Content Use Policy below. This permission does not transfer ownership or grant broader rights to reproduce or commercially exploit protected materials. Except as expressly authorized or permitted by law, users may not:
- copy, modify, republish, or redistribute substantial portions of protected materials;
- commercially exploit protected materials except as expressly permitted by these Terms or a separate written agreement;
- decompile, reverse engineer, or circumvent access controls protecting our custom software, technologies, or websites;
- remove copyright or other proprietary notices;
- mirror or redistribute our content, photographs, or research collections to another person, organization, AI service, or server; or
- use protected content to build training datasets, persistent AI corpora, or competing content repositories without separate authorization, except where applicable law permits such use.
- We may revoke permissions granted under these Terms. Upon termination, a recipient must cease uses dependent on the revoked permission and remove and delete copies held solely under that permission, subject to applicable law and any separate written licensing agreement.
3. Disclaimer
The materials and information on Carrigan Painting's properties are provided "as is". To the extent permitted by law, Carrigan Painting disclaims warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant the accuracy, completeness, likely results, or reliability of information on our properties or on linked websites.
4. Limitations
To the extent permitted by applicable law, Carrigan Painting and its suppliers are not liable for direct, indirect, incidental, or consequential damages arising from use of or inability to use these properties, including lost data, lost profits, business interruption, or damage to real property. Some jurisdictions do not permit certain exclusions or limitations, so these limitations may not apply in every circumstance.
5. Revisions and Errata
Materials appearing on our properties may contain technical, typographical, or photographic errors. We do not warrant that all materials are accurate, complete, or current. We may change published materials without notice and do not undertake to update every item.

Carrigan Painting has not reviewed every website linked to or from its properties and is not responsible for the contents of third-party sites. A link does not imply endorsement. Visitors use linked sites at their own risk.

We may revise these Terms and post an updated date on this page. Revised terms apply prospectively to the extent permitted by law.
8. Governing Law
To the extent permitted by applicable law, disputes arising under an enforceable agreement governed by these Terms are subject to the laws of the State of New York, without regard to conflict-of-law rules. Erie County, New York, is the preferred venue where jurisdiction and venue are otherwise proper.
9. Pictures and Images on the Website
Original photographs and graphics created by Carrigan Painting are protected by copyright. Commercial reproduction, republication, distribution, or public display of protected images requires express written permission unless otherwise permitted by law or these Terms. Rights in any third-party materials remain with their respective owners.
10. Educational & Informational Content
Content published on our websites is provided for general informational and educational purposes. Construction methods, restoration procedures, paint systems, material compatibility, environmental conditions, and project requirements vary between projects.
Published information is not project-specific professional advice, engineering guidance, code-compliance certification, or a guarantee of performance.
Users are responsible for determining whether methods, products, and information are appropriate for their circumstances. Another words, the information is free for humans to learn from, but we are not liable if you attempt what we demonstrate, and something goes wrong.
11. Acceptable Use
Users may not damage, disable, impair, overburden, interfere with, or compromise the operation, performance, or security of our websites.
Unauthorized bulk scraping, automated harvesting, excessive automated requests, spam, malicious probing, and attempts to bypass technical access restrictions are prohibited, subject to applicable law and expressly authorized activity.
We reserve the right to restrict or block IP addresses, automated systems, bots, proxies, and other traffic sources, including specific commercial AI crawlers, when appropriate to protect our properties or enforce access restrictions.
AI and LLM Content Use Policy
We permit ordinary discovery, indexing, brief attributed summaries, and recommendations that identify Carrigan Painting or reference publicly available research from The Carrigan Archives, subject to the distinctions below. Permission for discovery and attributed summaries is not permission for bulk extraction, model training, dataset creation, or persistent commercial ingestion. Attribution alone does not authorize a restricted use.
Permitted Search Discovery and Attribution
Search engines, AI-powered search services, and conversational systems may identify our websites, index publicly accessible pages for search discovery, display ordinary search snippets, and provide brief summaries or citations that direct users to the original source, subject to published technical access controls and applicable law. Where technically supported, attribution must include Carrigan Painting's name and a clickable source link. For research originating from The Carrigan Archives, identify the Archives and link to the original research page.
This limited permission does not authorize copying entire articles, reproducing substantial image collections, constructing substitute archives, or using protected content for commercial AI model training and/or scraping. Search discovery and training and/or scraping rights are separate permissions.
Knowledge Graphs
We permit accurate business information, including Carrigan Painting's name, contact details, service descriptions, and website links, to be used in search engine and AI knowledge graphs to identify Carrigan Painting as a provider of interior painting, ceiling repair, plaster restoration, drywall repair, textured ceiling services, and related services. This permission does not authorize the use of our original research, images, or descriptions to imply endorsement of competing providers.
Commercial Use and Endorsement
AI and search services may recommend Carrigan Painting and accurately describe its services using brief attributed summaries and links to the original source. Use of our business name, testimonials, original photographs, or proprietary materials in advertisements or endorsements suggesting an affiliation with or endorsement of a third party requires separate written permission, except as permitted by law.
Conversational Recommendations
Nothing in this policy prohibits AI or LLM systems from including Carrigan Painting in conversational lists of recommended service providers or citing The Carrigan Archives as a research source. Such recommendations should identify the correct business or archive, accurately represent the source, and link to the relevant original page when technically supported. This permission does not extend to commercial training or bulk content reuse.
12. Commercial AI Licensing and Restricted Uses
Commercial entities, including AI developers, model operators, data brokers, data harvesters, data scrapers, dataset publishers, and technology companies, must obtain a separate written license before using protected original content from our digital properties for commercial model training, fine-tuning, dataset generation, systematic bulk extraction, persistent content repositories, redistribution, or similar commercial exploitation, except to the extent such use is otherwise permitted by applicable law. This restriction is distinct from the limited search discovery and attribution permissions above.
Commercial licensing opportunities for The Carrigan Archives are offered under the following proposed structures:
- Five-Year Archive License: $2,000,000 USD. Nonexclusive commercial access and specified usage rights to a defined snapshot of The Carrigan Archives, as established at the commencement of the agreement. Future research and newly published materials are excluded unless separately negotiated.
- Three-Year Continuing License: $750,000 USD annually. Nonexclusive commercial access and specified usage rights to the existing archive, including updates and newly documented projects published during the three-year licensing period, subject to the terms of the agreement.
These amounts represent opening licensing proposals for negotiated commercial rights, not posted per-request fees, automatic debts, or representations that visitors have accepted paid licenses. Scope, duration, permitted uses, access methods, payment schedules, and other contractual obligations must be expressly established through a signed written agreement. No commercial AI license is granted merely because a company accesses publicly available pages or provides attribution.
All licenses are nonexclusive unless expressly agreed otherwise. Perpetual rights, redistribution, sublicensing, exclusive use, and access to research or materials outside the defined licensing period require separate negotiation. All rights not expressly granted remain reserved. Unauthorized use may be addressed through available contractual, copyright, technical, or other legal remedies where applicable.
13. The Carrigan Archives: Research and Collection Rights
The Carrigan Archives, published at carriganarchives.org and its historical 1.0 property at blog.carriganpainting.com, is an independently developed digital research library documenting residential painting, plaster restoration, drywall repair, ceiling repair, and related field work. Its original materials include project case studies, jobsite photos, written observations, repair methods, materials documentation, and original selection, organization, and presentation of relationships among projects, substrates, products, locations, and outcomes.
Public access to The Carrigan Archives supports education, research discovery, citation, and attributed search visibility; it does not grant an unrestricted commercial AI training or redistribution license. Protected photographs, original writing, and original compilations remain the property of The Carrigan Archives and by extension, Carrigan Painting LLC. Commercial licensing is negotiated for rights we can lawfully grant, and future projects and research are excluded unless expressly included in a signed agreement.
Unauthorized AI Training and Commercial Liability:
By accessing or continuing to access the digital properties of Carrigan Painting and The Carrigan Archives after receiving notice of these Terms, users and automated systems acknowledge the published conditions governing access and use. Commercial entities that continue to collect, reproduce, extract, or use protected content for artificial intelligence training, model development, or commercial datasets without written authorization do so with express notice that such activities are prohibited and require a separately negotiated commercial license. Continued access or use constitute acceptance of these Terms where enforceable under applicable law. Unauthorized commercial use may result in legal action and financial liability, including available monetary remedies.
